Privacy policy for www.ans.care from 01/14/2022.

Our goal is to provide you with a sense of security on our website, therefore your privacy and protection of personal rights are important to us. Please read the following summary carefully as to how our website works. You can rest assured that your data will be processed in a transparent and fair manner and that we will make every effort to ensure that your data is treated with care and responsibility.  

The following Privacy Policy is intended to inform you about how we use your personal data, for which we meet all the requirements of the Polish Data Protection Act and the requirements of the General Data Protection Regulation (GDPR).

Purposes of processing and legal rules governing the manner of processing your personal data

We collect and process your personal data only to the extent that is necessary to ensure the functioning of the website. We collect, process, and use your personal data for the following purposes:  

 

Conclusion and performance of contracts

Marketing activities such as lotteries with prizes

Customer service and customer support

Provision of broadcast media services, e.g. to process orders for goods and services we offer over the Internet

Your personal data may be processed on the basis of the following legal principles:  

Art. 6, par. 1 lit. a GDPR is a legal basis for processing activities for which we obtain your consent for a given processing purpose.

Art. 6, par. 1 lit. b GDPR says that personal data may be processed for the performance of a contract, e.g. when purchasing a product. The same applies to any processing activities necessary to carry out pre-contractual activities, such as handling inquiries about products or services.  

Art. 6, par. 1 lit. c GDPR applies in cases where we have a legal obligation to process personal data, for example, to fulfill tax obligations.  

Art. 6, par. 1 lit. d GDPR says that personal data may be processed in order to protect the vital interests of your person or another natural person.

Art. 6, par. 1 lit. f GDPR applies to our legitimate interests, for example when hiring service providers to fulfill orders (e.g. delivery services), when completing statistical surveys and performing statistical analyzes, and when trying to log in or ensure security on the website. Our interest is to provide a user-friendly, attractive, and secure website and to optimize it in order to meet both our business goals and your expectations.

 

The period of storage and the process of removing personal data

We process and store your personal data only for as long as is necessary to fulfill the purpose of their storage or as long as we are required to do so by law or regulations. As soon as the purpose ceases to apply or has been fulfilled, your personal data will be deleted or its processing will be restricted. In the event of restriction of data processing, such data will be deleted as soon as the data retention periods imposed by law, the company's articles of association/articles of association or the provisions of the contract cease to prevent such deletion, unless there is a reason to assume that such deletion would jeopardize legitimate interests and provided that such removal would not require a disproportionate effort due to the special nature of the storage.

 

Collection of general data and information (log records)

Pursuant to Art. 6, par. 1, lit. f GDPR, our website collects a series of general data and information each time it is accessed, which is temporarily stored in the server log files. The log record is created as part of the automatic logging performed by the processing computer system. The following data can be collected:

Access to the website (date, time, and frequency)

The method of landing on the page (referrer, hyperlink, etc.)

Data volume transferred

The browser you are using and its version

The operating system you are using

The Internet Service Provider you are using

An IP address assigned to your computer by your Internet Service Provider when connected to the Internet

The collection and storage of this data are required for the website to function in order to ensure the functionality of the website and the correct display of the content of our website. We also use this data to optimize our website and to ensure the security of our information technology systems. Therefore, the data is kept for prudential reasons related to technical aspects for a period of seven days.

 

We also use this data for marketing, market research, and definition and structuring of our services to meet demand by creating and analyzing pseudonymous usage profiles, but only if you have not exercised your right to refuse or withdraw your consent to use your data in this way (see the notes on your right to object in the " Your rights " section).  

 

Cookies, web analysis services, and social media

We use cookies, web analysis services, and social media plugins on our website, for which there is a separate Cookie privacy policy.

 

Providing information about our products and services, special offers, and other news such as newsletters

We use your data to send the information you request regarding our products, services, and other special offers to the e-mail address provided by you. The above will only take place with your prior consent or if it is permitted by law. Granting consent to such transmission is governed by Art. 6 par. 1 lit. a and art. 7 GDPR.  

Registration on our website for newsletters  

You can subscribe to a free newsletter on our website. When registering for the newsletter, the data from the data form will be sent to us, i.e. at least your e-mail address.  

 

Stationary registration

If you register with a specific retail facility website to receive information by email, we will store your email address along with the name of that regional retail facility so that we can provide you with region-specific information about our products and services.

 

Deliveries related to the sale of products and services

If you purchase products or services on our website, we may send you information about our own, similar products and services to the e-mail address provided by you, even without your consent.

 

Postal shipments

We may also use your data to send information about our products, services, and special offers by mail.

We want you to enjoy reading our e-mails, so we try to include only information that is likely to be interesting for you. Therefore, we measure and store the frequency of entries and clicks on your user profile, as part of the Administrator's justified purpose (Article 6 (1) (f) of the GDPR). This information includes data on if and when you open our emails, what content you click on in these emails, and when, and whether and why our emails may not reach you. We also use this data for statistical purposes.

Of course, you can also unsubscribe to stop receiving such e-mails, i.e. withdraw your consent with effect for the future, for which purpose an appropriate unsubscribe link is included in every e-mail and newsletter. You will then be asked to confirm your unsubscription on our website. You can also contact us to withdraw your consent at any time:

It is not possible to unsubscribe from receiving certain informational messages required for the performance of contracts and for the operation of our website, including service-related e-mails (e.g. registration confirmations, customer service information) or information about purchases (e.g. order confirmations, contract documents relating to payment processing). You will receive these notifications according to the contact details provided.

 

Processed personal data when making contact, after registration, and when placing orders without registration

Making contact

The information provided by you when contacting us by phone, e-mail, or via the contact form will be stored by us on the basis of art. 6, par. 1, lit. f GDPR, in order to answer your questions. The contact will be recorded in a register so that we can prove that the contact took place as required by law.  

 

Registration:

On our website, we offer you the option of registering by providing personal data. This data is entered into a data form and transmitted to and stored by us. Registration is made in order to perform the contract or carry out activities aimed at concluding the contract and therefore the basis for them is Art. 6, par. 1, lit. b GDPR.

In order to conclude and perform contracts, we require contact details depending on the specific case, for example, name and surname, delivery address, invoice address, e-mail address, and information on the selected form of payment. We also use your data to maintain our customer data, where only the most relevant data is stored.  In order to prevent typographical errors (so-called "typos") and to ensure that the ordered products are actually delivered to you, we check the completeness and correctness of your address when you enter it.  

Orders placed without registration:

You can place an order as a visitor, that is, without registration. If you choose this method of ordering, you do not need to register before ordering. Please note that you will have to re-enter your details when placing future orders. For orders without registration, we collect, process, and use the data provided by you to perform the contract, in accordance with art. 6, par. 1, lit. b GDPR. We store the information you provide for the duration of the processing and execution of your order. Your data will then be deleted unless you decide to activate your customer account within 14 days of placing your order. Processing of data that we are required to store in accordance with statutory requirements, articles of association, or contractual requirements will be restricted to prevent its use for other purposes, but will not be deleted.

 

Miscellaneous

Based on Article. 6, par. 1, lit. c and f GDPR, we use and store your personal data and - where necessary - technical information, in order to prevent misuse of data or other illegal behavior on our website, or to conduct investigations in such cases, e.g. to ensure data security in the event of attacks on our IT systems. This may be carried out on the basis of orders of public authorities or common courts if required by law, as well as to protect our rights and interests and to enable us to defend ourselves in court.

 

Transmission of personal data to third parties

When transferring your personal data, we ensure that the level of security is always the highest possible, therefore your data is only transferred to carefully selected and related contractual obligations to service and partner companies. We transfer your data only to entities located within the European Economic Area and thus subject to strict EU data protection regulations, or to one that is bound by an appropriate security standard. Data transfer to third countries is not currently being practiced or planned.

Use of the chat function with an IT consultant pursuant to Art. 6, par. 1, lit. f GDPR

In order to provide you with even greater comfort of using our services, we offer the "Chat with an IT advisor" function. It allows you to get advice using the chat function before making a purchase on our website. The entire chat process is anonymous and your name or other personal data will not be displayed or entered in the logs, nor will the customer advisor be able to view your customer data. In order to continuously improve the quality of our customer advisory service via chat, we save chat entries for training purposes. These records are deleted after review.

 

Your rights  

Of course, you have rights in connection with the collection of your data, which we are pleased to inform you about here. If you wish to exercise any of these rights for free, simply send us a message. For your safety, we reserve the right to obtain further information when answering an existing inquiry in order to confirm your identity. If identification is not possible, we also reserve the right to refuse to respond to your inquiry.

The right to access data

You have the right to request information from us regarding the personal data we hold about you.  

 

Right to rectification

You have the right to demand immediate rectification and/or completion of the personal data stored on you.  

 

Right to restriction of processing

You have the right to demand that the processing of your personal data be restricted if you question the accuracy of the data stored about you if the processing is unlawful and we no longer need the data, but you do not want the data to be deleted and you require them in order to declare, exercise or defend rights resulting from legal provisions, or if you have presented your objection to their processing.

 

Right to erasure  

You have the right to request the deletion of your personal data stored by us, unless the maintenance of the data is necessary to ensure freedom of speech, freedom of access to information, fulfill a legal obligation, for reasons of public interest, for the purpose of reporting or defending against claims or in for the purpose of claiming legal rights.

 

Right to information

If you have reported the right to rectify, delete or limit data processing, we will notify all recipients of your personal data about the method of rectification, deletion, or imposition of restrictions on the processing of this data, unless it is impossible to carry out or involves a disproportionate effort.  

 

The right to data portability

You have the right to obtain a copy of the data provided to us, which will be sent to you or a third party in a structured, standard, machine-readable format. If you request that this data be sent to another data controller, this will be done, as long as it is technically possible.

 

Right to object

If your personal data is processed for the legitimate interest of art. 6, par. 1, lit. f GDPR, you have the right to object to the processing at any time pursuant to Art. 21 GDPR.  

 

Right to withdraw consent

You have the right to withdraw your consent to data collection at any time with effect for the future. This will not affect the data collected so far. We hope you understand that for technical reasons, it may take a certain amount of time to process your withdrawal of consent and that you may continue to receive communications from us during such a period.

 

The right not to be subject to decisions based on automated processing, including profiling

You have the right not to be subject to a decision that is based solely on automated processing, including profiling if such a decision produces legal effects for you or similarly significantly affects you.

 

Right to lodge a complaint with a regulatory authority

If the processing of your personal data violates data protection regulations or if your data protection rights have been violated in any other way, you can submit a complaint to the regulatory authority.

 

Please note that once you delete your data, you will no longer be able to access services related to our products through our website. The above may also include internet download services. Therefore, we encourage you to make a backup (backup) of your data before exercising the right to delete it. The processing of data that we are required to store in accordance with statutory, articles of association or contractual requirements will be limited to prevent its use for other purposes, and will not be deleted.

 

Changes to the Privacy Policy

In order to ensure that our Privacy Policy complies with the current statutory requirements at all times, we reserve the right to amend it at any time. The above also applies in cases where the Privacy Policy requires changes to cover new or changed products or services.
